Responsabilidad de los socios por las deudas de la sociedad en materia tributaria

Abstract

El presente tema de reflexión está orientado a describir cómo opera la responsabilidad de los socios respecto de las deudas de la sociedad en materia tributaria. Con el objeto de ubicarnos en el tema, primero haremos una descripción somera de la relación jurídica tributaria, el papel del hecho generador como estructura jurídica del tributo y sus elementos. Después se hará referencia a la responsabilidad en materia tributaria y sus especies, solidaridad y subsidiariedad para finalizar con el estudio del tema central a la luz de la jurisprudencia de la Corte Constitucional.

Abstract: Th is issue of refl ection is intended to describe how operates the responsibility of members of the society relating to tax debts. For placing us in the topic, we will fi rst do a brief description of the tax legal relationship, the role of the operative legal structure of the tribute and its elements. It will then be reference to the responsibility on tax matters and their species, solidarity and subsidiarity to fi nish with the study of the topic in the light of the jurisprudence of the Constitutional Court.
