Ley de justicia y paz y el marco legal para la paz ¿un paso más hacia la impunidad?

Abstract

En este artículo de reflexión se lleva a cabo en una primera instancia, una aproximación a las causas de la perpetuación del conflicto armado en Colombia, desde los argumentos planteados por autores como Sánchez (2010), Uribe y López (2006) y Bernal (2010). Posteriormente se analiza la Ley de Justicia y Paz, que en el sentido de la memoria anamnética y de los postulados de Garavito (2009) y Metz (1999) vale la pena destacar, al respecto sus aportes en los procesos de desmovilización de los grupos armados durante el segundo periodo del expresidente Álvaro Uribe Vélez. Finalmente, una lectura crítica en el sentido de lo que la memoria anamnética, el perdón y olvido, por promover la impunidad, han llamado la atención de la opinión pública sobre la Ley de Justicia y Paz.

Abstract. In this reflective paper, there is an approach to the causes of the perpetuation of armed conflict in Colombia, since the arguments raised by authors like Sanchez (2010), Uribe and Lopez (2006) and Bernal (2010). Moreover, it analyzes the Law of Peace and Justice, in the sense of the memory anamnetic and the postulates of Garavito (2009) and Metz (1999) that is worth mentioning, in the regard of their contributions of peace by quitting the groups armed during the second Presidential term of former President Alvaro Uribe Velez. Finally, there is a criticism to the Law of Peace and Justice in the sense of forgiveness and forgetting the crime and therefore it promotes impunity, which have caught the attention of public opinion on the justice and Peace Law.
