El medio ambiente Un concepto jurídico indeterminado en Colombia

Abstract

El medio ambiente como concepto jurídico constituye un verdadero reto en su definición y delimitación. No es fácil afrontar este propósito y por tanto no existe uniformidad en su contenido, siendo posible sin embargo identificar algunos patrones comunes que permitirían la construcción de una definición; la cual recibirá de inmediato numerosas críticas en razón de su alta contaminación subjetiva. El concepto legal de medio ambiente ofrecido por la ley colombiana es restrictivo e inexacto y sólo se refiere a uno de los componentes del mismo. El hombre sí forma parte del medio ambiente pero la protección de sus derechos escapa al ámbito de aplicación del derecho ambiental, al que le compete la salvaguarda de los demás elementos integrantes del medio ambiente.

Abstract: The environment as a legal concept constitutes a real challenge in its definition and delimitation. It is not easy to face this purpose and therefore it doesn’t exist uniformity in its content, being possible however the task of identify some common patterns that will allow us to build a definition; which will receive immediately a lot of critics in reason of its high subjective contamination. The legal concept of environment offered by the Colombian law, is restrictive and inaccurate, and only refers to one of the components of the same. The man is part of the environment but the defense of it rights escapes to the field of environmental law application, which is responsible of the protection of the other environmental elements
