Análisis de la jurisprudencia C 836 de 2001 emanada de la Corte Constitucional

Abstract

El presente trabajo tiene como finalidad compartir la idea según la cual hoy se hace necesario estudiar con mayor vigor la figura de los precedentes jurisprudenciales; por ello de una manera sencilla, exponemos un análisis de una jurisprudencia emanada de la Corte Constitucional, donde se da ha conocer los distintos pasos que hay que tener en cuenta para estudiar una jurisprudencia y encontrar en ella la ratio decidendi, que en últimas es donde se halla la fuerza vinculante. Se trata de una propuesta para discutir y se considere como una norma jurídica. Detrás de todo ello, prima para todos la obligación de educarnos al respecto.

Abstract: The present work has as purpose of sharing the idea whereby today it becomes necessary to study with more vigour the figure of the jurisprudential precedents, for it in a simple way we expose an analysis of a jurisprudence come from the Constitutional Court, where praise announces different steps that are necessary to bear in mind to study a jurisprudence and to find in it the ratio decidendi, which in last is where the binding force is situated. This is a proposal for discussion and it considered as a legal norm. Behind it, prime for everybody the obligation to educate ourselves in the matter.
