Ruptura con la postura hegemónica, camino de reconocimiento de las minorías

Abstract

El pensamiento Liberal Clásico estructuró el Estado moderno a través de la teoría del pacto social, la supremacía de la ley y el reconocimiento del hombre como un ser racional y autónomo, en donde el valor fundamental es la libertad. Sin embargo, al establecer un Estado se definió una identidad y un orden que nace según la teoría política del mismo pueblo (pacto social). No obstante, al mismo tiempo que promueve esa identidad, está rechazando la diferencia porque legalmente no está reconocida en la generalización establecida por la ley. Por eso, es necesario buscar otros aspectos conceptuales que abra el Estado hegemónico al reconocimiento de la diferencia. Además, Colombia, desde 1991, creó un marco legal para garantizar la vida de las minorías, pero cómo generar una concertación que plantee una real inclusión es el reto actual.

Abstract: The Liberal Classical thinking structured the Modern State through the social pact theory, the supremacy of law and the recognition of the man as rational and autonomous being. However, with the creation of the state a certain identity an order emerge according to the political theory. Never the less at the same time that identity rejects the difference because it is not legally recognized in the written law. For that reason, it is necessary to look for other conceptual aspects which open the Hegemonic State to the recognition of the differences. In addition, Colombia since 1991 created a legal frame to guaranteed the survival of the minorities, but the generation of real social inclusion it is still a challenge.
