En la realidad jurídica existente en un proceso, salvo las excepciones del caso, se requiere la existencia efectiva y física del demandado, quien si por alguna circunstancia no puede o no quiere concurrir a ese escenario -como es el proceso- se debe, bajo instituciones constitucionales y legales, suplirse en mandatarios designados por el Juez para velar por el debido proceso
y cumplir con uno de los tantos actos, como es trabar la Litis y ejercer el derecho de defensa ante las postulaciones expresadas por el demandante y de esta manera proseguir con las otras etapas demostrativas y resolutivas que enmarcan el proceso.
En este artículo de reflexión se analiza justamente esa delegación que hace el Juez, en otra persona distinta al demandado en rebeldía o en incapacidad para comparecer, para mostrar como no se está cumpliendo con la verdadera finalidad que busca esa delegación muy a pesar de las reformas procesales que se han dado en lo referente a la figura y sobre quién recae ésta defensa; por constituirse dichos patrones, en una herramienta más para llenar un vació del que está ausente y no para la protección de sus derechos y de esta forma poder garantizar una tutela y una igualdad entre las partes que concurren al proceso. Constituyéndose por lo tanto en un instrumento aunque obligatorio, carente de defensa técnica y revestido de parcialidad, ante las disposiciones de la legislación actual y las reformas traídas por el Código General del Proceso.
Abstract. In the existing legal situation in a process, with the exceptions of some cases, the effective and physical existence of the defendant, who if for some reason cannot or will not go to that scenario, how the process is required, it must, under institutions constitutional and legal, be supplemented by agents appointed by the court to ensure due process and meet one of the many events, for instance, blocking the Litis and exercise the right of defense before the nominations expressed by the plaintiff and thus continue other demonstrative and decisive steps that frame the process. This article analysis the delegation that the judge does in someone other than the defendant in default or failure to appear, which is not being met with the true purpose, in spite of procedural reforms that have occurred in relation to person figure and who bears this defense; be constituted such patterns, another tool to fill a void which is absent and not for the protection of their rights and in this way to ensure protection and equality between the parties which contribute to the process. Thus constituting a binding instrument but, lacking technical and coated bias defense to the provisions of existing legislation and reforms brought by the General Code of Procedure.
