Abstract:
This thesis consists of an analysis of the conditions in which the inhabitants of rural areas
of the Department of La Guajira are found, specifically the municipality of Dibulla, in
relation to their right to Access to Justice due to the little intervention of the State with respect
to the provision of technological means, in other words, the scarcity of Information and
Communication Technologies.
The research problem arises from the concern of the researchers to make a diagnosis of
the current situations in the application of the right to Access to Justice due to the
insufficiency of technological tools (TIC) in the rural population of the Department of La
Guajira.
The research was carried out based on the case study methodology, obtaining information
from various sources, such as DANE, also from regulations, judicial maps, surveys and
testimonial narratives and a literary review on the Human Rights (Access to Justice) violated
in this case. The hypothesis was analyzed: “The lack of access to TIC (Tecnologías de la
Información y la Comunicación) in the rural population of Dibulla, La Guajira prevents their
access to justice.”
This favored the formulation of conclusions, which aim to demonstrate in a mixed way,
both qualitatively and quantitatively, that the current conditions in the application of ICT to
Access Justice are insufficient and a change in the country's public policies is necessary since
it is the State that is responsible for providing access to justice by any suitable means
